Wayne Goza v Sarah Goza, 470 So. 2d 1262 (1985) - Non Compos Mentis is now used as a general term for "of unsound mind" and is legally defined as not having the capacity to make decision, and has been ruled to be a higher threshold than merely a mental illness. Genetic disorders such as Down Syndrome would be covered by the term depending on decision making capacity.
