- McGaw V Welsh Ministers [2020] EWHC 2588 (Admin) a decision of Judge Jarman about the interpretation & limitations in Class E of the GPDO as it applies in Wales including whether backfilling land lies outside Class E.
- R ( Lochailort Investments Ltd ) V Mendip District Council [2020] EWHC Civ 1259 a Court of Appeal decision relating to land designated as local green spaces in Norton St Philip Neighbourhood Plan and the lawfulness of Policy 5 governing their development.
Appeals of the Week
- DCO consent granted on 11 October by SoS for BE&IS for a 97km pipeline between Southampton & London applying a presumption in favour of oil pipelines & where the need for the project outweighed the harm.
- A section 78 appeal decision letter dated 7th October relating to 128 affordable dwellings on land outside the settlement boundary, off Aviation Lane, Burton on Trent.
