Description

This lawed up episode hosted by Brian Jackson breaks down the 14th Amendment. The 14th Amendment is a important pat of constitutional law and is good to get a better understanding of it. This episode focuses on the equal protection protection clause of the constitution. We go over how the 14th Amendment came about and how it started incorporating the states to the federal constitution. We also go over the slavery issue, the Dred Scott case and how that came about. We also go over the Plessy Ferguson case and separate but equal and the Jim Crow era and then talk about Brown v. Board v. Education and how that decision changed the 14th amendment and brought us into the civil rights era. We then go into the current analysis of the equal protection clause and the levels of scrutiny, including strict scrutiny for laws based on race and intermediate scrutiny for laws based on gender.
