Rapid advances in generative AI and deepfake technologies have made it possible to create extremely realistic digital replicas of individuals, capable of reproducing the appearance, voice and even mannerisms of deceased actors. 1 This ability opens up unprecedented creative and commercial horizons, making it possible to "resurrect" iconic figures for new performances or to complete unfinished projects. However, this innovation simultaneously raises a series of intricate legal issues, ranging from intellectual property to personality rights, from privacy to data protection, especially when it comes to deceased individuals. The simple notion of "having rights" turns out to be much more complex than it may appear at first glance, requiring an in-depth analysis of different areas of law and their post-mortem application.
