SC2023-0073 State of Florida v. Michael John Phillips

Phillips was convicted of two counts of DUI manslaughter and successfully challenged the sentence on one count. The trial court then resentenced and increased the prison time on the second count. Phillips argues the resentencing violated the prohibition against double jeopardy. Upon the State’s motion, the Second District Court of Appeal certified a question of great public importance regarding Florida’s sentencing model.

SC2024-0584 Tacorius Cordale Stallworth v. State of Florida

A jury found Stallworth guilty of first-degree murder and two counts of aggravated battery. The appellate court below upheld Stallworth’s convictions and sentences, rejecting his argument that the trial court erred in refusing to give a jury instruction on the defense of duress. Stallworth now asserts that the appellate court’s ruling conflicts with decisions from other courts and was wrong.
