Description

Last week, the Supreme Court allowed ten states to block the Biden administration’s attempt to promulgate new rules to Title IX of the Educational Amendments of 1972. Brad Yates explains why the Biden administration wanted the preliminary injunction to be more limited, describes the impact that the Loper Bright v. Raimondo case may have on the Title IX rule changes, and speculates that Bostock v. Clayton County might support the Department of Education’s interpretation.
