Ulrich Roux, an attorney and the Managing Director of Ulrich Roux & Associates, joins us to explain why a marriage contract is important and what your options are. Often people who are planning to get married think that they will never get divorced and don’t enter into a prenuptial contract, but this has big implications for your finances should your marriage end. Nobody knows what the future will hold, and to ensure that you and any children from the marriage are sufficiently looked after, it is important to consider a marriage contract.
Ulrich suggests that getting married out of community of property with accrual applied is the most fair regime, but it is important to get advice specific to your own situation. We also cover cohabitation agreements which can be used in the case where people in a long term relationship have no intention to get married.
These can also be used for customary marriages that are not recognised as a civil union and where civil law is not applicable.
