On October 21, 2021, actor #AlecBaldwin pointed what he knew to be a real gun at Ukrainian cinematographer Halyna Hutchins, while filming on the set of the movie "Rust" in New Mexico, without first ensuring that the real gun was not loaded, and shot and killed her.
On these simple facts alone Alec Baldwin's conduct in the death of Halyna Hutchins qualifies as involuntary manslaughter under New Mexico law every day of the week and twice on Sunday.
Although Baldwin was initially charged with manslaughter, that charge was dropped in April of this year, for reasons that can have nothing to do with legal merit. That said, the charges were dropped WITHOUT PREJUDICE, and prosecutors reserved the privilege to refile if new evidence consistent with guilt developed.
Last week we learned that, indeed, new evidence of guilt has developed. A state report by a firearms examiner has concluded that the pistol in Alec Baldwin's hand that killed Hutchins could not have fired without the trigger being pulled--despite Baldwin's protestations that the gun did precisely that, discharging without him depressing the trigger.
Does this mean that we can look forward to some genuine criminal justice in the criminal killing of Halyna Hutchins?
