Earlier this year Federal law enforcement sought to execute a search warrant an a mother and her two adult sons for living unlawfully on Federal park land.
Because one of the sons had previously made threatening statements, the arrest was made surreptitiously by plain-clothes officers pretending to need a jump-start for their truck.
When one of the brothers, named Timber, prepared to help the as yet unidentified officers, they initiated his arrest. That brother then started screaming for help from his other brother, Brooks, who happened to move around in a wheelchair.
Brooks rolled up in his wheelchair, saw his brother struggling with two men, and pointed a revolver at the two men. Unknown to Brooks he was more or less surrounded by other plain-clothes cops, who immediately began firing at him. Brooks would survive the shooting, but be paralyzed through his gunshot injuries. (He is now suing the Federal government for $50 million.)
Could it have been lawful for Brooks to point his revolver at the officers making a lawful arrest of his brother Timber?
Could it have been unlawful for the officers to respond to Brooks' revolver with their own gunfire?
