On November 22, 2012, Nicholas Brady and Haile Kifer were shot and killed while breaking and entering into the home of Byron David Smith. At first glance, it seemed that Smith was within the bounds of Minnesota’s “Castle Law” which allows a homeowner to use deadly force to protect his or her home. A discovery of surveillance footage, and Smith’s audio recordings give investigators pause. We will examine the complex details of this case, and what led a jury to convict Smith of premeditated murder.
