Description

This episode is hosted by Fountain Court barrister Niamh Cleary and looks at future trends in insurance litigation.

The discussion covers a range of topics, including insurance disputes likely to arise out of the COVID-19 pandemic (other than business interruption coverage that is already very much front and centre in the legal news).

We also discuss more long-term trends, such as the impact of climate change on the insurance market and likely developments on discrete and, to date, under-litigated issues such as the duty of fair presentation under the Insurance Act 2015.

Joining Niamh in the discussion are:

• Fountain Court silk Ben Lynch QC, who specialises in insurance, commercial litigation, professional negligence, competition and telecoms. He is an editor of MacGillivray on Insurance Law and appeared in the recent FCA Test Case on business interruption insurance.

• Clyde & Co’s Global Head of Insurance and Head of the Financial Institutions and D&O team James Cooper, who is currently involved in a number of ‘catastrophe’ claims, particularly class action claims emanating from the US.

• Allen & Overy Partner Joanna Page, who is responsible for developing the firm’s Contentious Insurance group. She is a member of the Editorial Board for PLC and is the editor of The Insurance Disputes Law Review.
