Tantillo argued that JPMorgan Chase could not provide the necessary documentation to the Plaintiff’s regarding the loans they purchased, while borrowers whose loans were sold to JPMorgan Chase could not obtain proof regarding the ownership of their loans. Loans sold without proper documentation (notes, reconveyances and assignments) are void, not voidable. JPMorgan Chase foreclosed on “loans” with no legitimate documentation by hiring Nationwide Title Clearing to create false title and paperwork necessary to foreclose. To avoid costly and time consuming legal obligations it faced under the Acts, JPMorgan Chase warehoused loans in a database of charged-off loans known as RCV1 and intentionally and recklessly sold these liabilities to unaware buyers.
