Lawyers had argued his wife faced "imminent" death from a brain injury -- if Dougherty wasn't allowed to care for her while serving the rest of his sentence on house arrest.
The judge says while Cecilia Dougherty's "ongoing situation is extremely unfortunate, it does not outweigh, at this point in time, the need for the punishment" given to her husband.
Johnny Doc is serving a six-year prison term for bribery and corruption, with a projected release date of October 2029.
