SCOTUSblog's Zach Shemtob on the Court's New Gun Decisions
This week, the Supreme Court cleared its slate of gun cases. It made three substantial moves along the way. First, it finally revealed what it would do with long-languishing cases against Rhode Island's magazine ban and Maryland's AR-15 ban. Then, it decided, unanimously, whether Mexico could sue Smith and Wesson over cartel violence. To break it all down, we have the new editor of one of the premier Supreme Court publications. Zach Shemtob of SCOTUSblog joins the show to give his perspective on what the Court decided and what it means for future cases.

David Lat and Zachary Shemtob on Judicial Ethics in a Populist Age
In 2023, Supreme Court justices made news not only for the cases decided but also for their personal conduct. As David Lat and Zach Shemtob noted in an article for The Atlantic, the news stories often involved “financial entanglements between justices and wealthy benefactors.” As Lat and Shemtob discuss with Associate Dean Rodger Citron, the intensity of the public response to the justices’ behavior is more noteworthy than theunderlying conduct. They attribute the strong reaction to our current political era, which is not only hyper-partisan but anti-elitist as well. Lat and Shemtob discuss their article, the Supreme Court’s adopti...

The Trouble with 'Text, History, and Tradition'
Hello, AO listeners! This episode is a little bit different. Your regular hosts, Sarah and David, are unavailable—Sarah on parental leave, David on the road—so I (David Lat) have conscripted my husband, lawyer and legal commentator Zachary Baron Shemtob, to serve as guest of a guest. Zach shares his (strong) opinions on two hot topics, the Trump gag order and AO listeners’ favorite subject, text/history/tradition. We also cover a noteworthy Sixth Circuit case about the retroactivity of the First Step Act and the big Google antitrust trial. We hope you enjoy this very special episode. Sarah...

COVID-19 Diagnosis Confirmed One Year Later
Zach Shemtob, based in New York, was among the first wave of people to be infected with COVID-19, but it wasn’t until a year later that he was finally able to confirm the diagnosis. Initially, Zach and his husband, David Lat, both experienced flu-like symptoms. Zach’s symptoms eventually subsided; however, David was hospitalized at NYU Langone Hospital for 17 days with COVID and suffered lung scarring and now has heart issues. Zach was never able to find out if he had COVID because tests were in such short supply and he kept testing negative with the antibody tests. Whil...
