Und dennoch weisen die Praxis der Gerichte und auch die Lehre zu Artikel 8 der Bundesverfassung, der unter anderem die Gleichberechtigung von Mann und Frau vorschreibt, eine ganze Reihe von Lücken auf. Da und dort zementiert das so verstandene Diskriminierungsverbot bestehende Ungleichheiten oder verstärkt sie sogar. Das muss dringend geändert werden, sagt die Rechtswissenschaftlerin Elisabeth Joller, und sie zeigt auf, dass der Staat in der Pflicht steht, wenn es um die Herstellung von Gleichheit geht.
