The Provider Non-Discrimination law from the Affordable Care Act, which prohibits commercial payers from discrimi-nating against providers based on their licensure, has been in effect for more than a decade now. In 2020, Congress re-quired the federal government to issue rules and enforcement policies that would prevent commercial payers from dis-criminating against providers. But enforcement isn’t happening, and deadlines keep getting missed.
