纽约文化沙龙0114：万国公法与天朝的接地气之路 "追本溯源，国际法的雏形源于古希腊。而在遥远的东方，虽没有系统的文字记载，但国与国，邻邦与邻邦之间的交涉规则，更形同于“道德”一般悬于人心之上。千百年后的今天，人类文明的演进并没有削减世界范围内和区域性的纷争。而国际法作为国与国之间的法律规范，已经成为主权国家在国际舞台上必须掌握的通用语言。然而，对于国际法“恃强凌弱”的诟病却不绝于耳。虽为法律，但是缺乏对各国的约束能力和筹码，国际法往往成为一种空谈，或沦为大国霸权的工具。
那么，到底什么是国际法？它跟传统印象中的法律有何不同？
国际法从哪里来？是联合国造出来的么？安全理事会又是做什么的？
国际法存在的意义又是什么？
上述问题的答案，相信对大多数中国人来说都相当模糊，新闻中作为口号般喊出的“一切依照国际法行事”，也许就是我们对国际法的唯一直观印象。然而，即便在此明显不具备足够知识来做价值判定的情况下，私下里却依然常会听到国人诸如 “我不相信国际法”或者“国际法就是个屁”这样的言论，充满了对国际法的蔑视与不以为意。
国际法真的无足轻重么？轻视国际法有无道理？

纽约文化沙龙0093：聊聊美国的版权保护 "我们来自一个知识产权意识淡薄的国度。盗版软件、音乐、电子书成为天经地义，对弱者的抄袭、山寨几乎是默认行规。然而随着网络时代的去中心化，广大民众从智识价值的接收者逐渐成为创造者、传播者——此时这种淡薄所带来的，从“特权”变成切肤之痛。
对创作版权的保护，无疑是鼓励智识创作的核心堡垒。美国是怎么做的？他写在了宪法里，和一系列法案一起，形成版权保护的体系。在美国工作生活，应改掉以往的陋习，切记遵守版权保护的法律。
本期沙龙，有请来自NYU法学院的博士生张天璞，从历史和理论起源开始，基于法案、结合实例，和大家聊聊美国的版权保护。

所谓知识产权，简而言之就是通过自己的聪明才智所创造出来的对人类产生积极意义的东西。它涉及的法律包括三类：专利法、商标法，以及这次要谈的版权法。
对，这事儿跟你离得不远。它是你每天点开微信看订阅号的原创角标，也是你在知乎围观“为什么那么多人愿意无偿分享知识”的原因。
保护知识产权的传统，在安格鲁萨克森世界中根深蒂固。包括这些刚刚用暴力脱离跟母国隶属关系的美国的建国知识分子们。在他们的成长岁月中，他们无疑亲眼目睹了知识产权保护给发明创造和原创表达带来的动力，和这种动力如何以一种前所未有的速度提高着每一个人的生活水平。
这种重视被直接体现在了被奉为美国立国之本的《美利坚合众国宪法》之中。惜字如金的美国国父们，竟然单辟章节，专门用明文直接赋予美国国会为推动有用的科学和技术的进步而保障作者和发明人在一定限度的时间内享有用他们的作品和发明获利的专权。这就是美国版权保护的根本。
基于这种权利，美国国会从1790年开始，到1990年代，做出了一些列版权保护立法动作，其中1976年的美国《版权法案》（Copyright Act）和针对它的后续于1989年和1990年所做的修正案，加上法院系统对这些立法的解读和使用，一并构成了今日美国的版权保护体系。
在这一期沙龙，我想和你从源头及原因谈起，聊聊美国的知识产权保护，概括知识产权法的法制体系，以及自媒体节目的版权保护问题。
