总裁办电子邮件电邮讲话【2021】010号 签发人: 任正非任总在销售合同关闭工作座谈会上的讲话2021年1月26日我们要建立规范的合同管理体系,不但承担历史合同清理的责任,还要担负起面向未来合同的规范化管理。合同关闭工作组下阶段可以将历史合同清理的收尾工作交给合同管理部门,你们的主要精力放在科学的合同管理体系建设上。合同管理部门中没有这方面经验的人,可以分批接受轮训,两年内没有通过战略预备队培训班认证的人,不再从事合同管理工作。一些优秀专家要留在工作组把合同规范化管理形成白皮书,希望通过这些教材、这个机制培养一批干部和专家。下一阶段的重点工作:一是,加强政策、管理规定等合同管理能力建设;二是,加强合同管理战略预备队的训战,让更多的人理解合同管理的政策及规定,让正确的人去承担正确的职务;三是,将科学的合同管理方法从CNBG、EBG延伸到采购、研发等公司各个领域;四是,还要加强本地员工的赋能和培训。这样循环几年,公司的合同管理从机制上、从人员上全部正规化,当五年后吹响战略进攻的号角时,我们的冲锋就不会乱。你们这几年除了教书、育人外,逐批地走上战场,担负起重要的职务,我们的干部必须转成内行,将来就可以直接走上战场作将军。一、销售合同管理要从被动走向主动,面向未来建立科学的合同管理体系,输出规范化标准,实现合同管理的流程化、机制化,持续改进合同质量。第一,合同质量既支撑商业目标的达成,也是公司面对重大风险的屏障。我们要坚持签高质量的合同,要有合理的利润和现金流,可供应、可交付、可验收、回款有保障;风险敞口可控,责任界面清晰、有效期合理;对于已经签的质量差的合同,特别是风险高、持续亏损、现金流差的合同,主动规划改进;进一步识别现有长周期合同的风险与责任,并进行管理。第二,销售合同关闭要从被动管理走向主动管理,基于标准化流程实现IT系统自动化管理。大部分合同都应通过自动化的方式去关闭,比如在订货未发、开票未回款等节点上有异常,IT自动弹出提醒,这样让一线聚焦解决业务痛点,合同关闭人员聚焦处理少量的异常问题。合同关闭工作要进入日常例行状态,IT按年限设置预警并自动弹出。比如,未关闭的合同满两年时弹出一次,原合同管理责任人在位就一定要处理,如果他要调离,也应该写出对这个合同关闭的建议和处置措施。两年能关闭的合同就要两年关闭,否则第三年提醒一次,第四年提醒一次,第五年强制关闭。这样我们就能保持长期清醒,不会积累一大堆问题再来处理。任何合同都应该有期限,如果合同期限拖得太长,合同条件容易变更,清理难度就会加大。合同及时关闭的目的就是为了保持好的商业质量,对于超长期未关闭的合同,关键看它是否盈利、能否提高合同质量,如果盈利情况不好就要关闭。第三,将科学的合同管理方法从CNBG、EBG延伸到公司各个领域。下一步把采购卷进来,通过与CNBG和EBG的相互学习和借鉴,建立和优化采购合同管理体系,比如南下工作组;再把研发卷进来,共同参与训战,这样一步步地去改革,公司各个领域根据各自的业务特点建立科学的合同管理体系。
