After ICE began sweeping Los Angeles—pulling immigrants from job sites, courthouses, and homes—the city erupted in protest. In response, the Trump administration bypassed California Governor Gavin Newsom and deployed the National Guard. Now, Defense Secretary Pete Hegseth has sent in the Marines. How the Insurrectionist Might Use the Insurrection Act to Go After Non-insurrectionists
OA1123 - Insurrection enthusiast Donald Trump sure seems to be looking for an excuse to invoke the Insurrection Act of 1807 in a little-noticed section of one of his flurry of Inauguration Day executive orders. We review the history of how the Constitution and subsequent acts of Congress were written specifically to keep the President from deploying troops on US soil without a very good reason, and how and why the Act has been invoked 30 times in US history. When does civil disorder become an “insurrection” and when, if ever, can the President send in troops that a state hasn’t reque...

Democratic Backsliding: Constitutions and the Secret State
In this, the last episode of our first season, we’ll look at one final issue which bears on the question of backsliding – how democratic constitutions deal with the secret state. Even in democratic states some aspects of state activity are difficult or impossible to make fully transparent and accountable to the public. This is because some actions must necessarily be covert in order to be effective – from the operation of intelligence services to military operations and sensitive weapons systems . Governments may need to be able to protect certain information about this from public release, temporarily or - even...
