Charles de Montesquieu (1689-1755) Der französische Baron Charles Montesquieu entwickelte in seinem bekanntesten Werk, "Vom Geist der Gesetze ", die der Idee der Gewaltenteilung. Er entwickelte hiermit Lockes Idee weiter, die Staatsmacht durch Kontrollorgane zu "zähmen". Montesquieu schlug vor, dass die Staatsmacht in drei Teile aufgeteilt wird, in die 1. ausübende Gewalt der (Exekutive): Damit ist die Regierung und die öffentliche Verwaltung gemeint, zusammen mit allen dazugehörigen Staatsorganen, Ämtern, und Behörden. 2. gesetzgebende Gewalt (Legislative): damit ist das Parlament gemeint, das Gesetze beschließt. 3. die Rechtsprechung (Judikatur), die die Rechtmäßigkeit der Gesetze überprüft.
