Он дал возможность лицам без гражданства легализоваться и получить документ на постоянное проживание, вид на жительство, а в последующем и долгожданное гражданство без привлечения к административной и уголовной ответственности. 25 декабря текущего года срок действия закона об амнистии заканчивается. Сегодня в 8-ю годовщину глобальной кампании УВКБ ООН #IBelong по ликвидации без гражданства с нашими гостями координатором проекта по вопросам без гражданства Екатериной Смоляковой и директором общественной организации «Право и процветание» Наджибой Ширинбековой мы обсудили как проходила амнистия, успели ли все те, кто долго ждал документов, получить их, есть ли необходимость продлить действия закона. Как отметила Наджиба Ширинбекова, данный закон сформировался из практики, он также отличается практичностью, в нем прописано какие шесть категорий граждан подпадают под его действие. Под действия данного закона подпадают лица из числа граждан бывшего Советского Союза, незаконно находящиеся на территории страны, и въехавшие до 31 декабря 2016 года. Эксперты рассказали как устанавливается правовой статус лица без гражданства, как в соответствии с законом можно легализовать свое нахождение в Таджикистане. Кроме того, мы обсудили кто относится к группе «лиц под риском без гражданства», эту группу так же называют лицами с неопределенным гражданством. «Это те лица, которые не могут доказать свою принадлежность к гражданству какому-либо государства. Мы выявили большое количество таких лиц, которые в соответствии с законодательством страны являются гражданами Таджикистана, но им надо будет предоставлять дополнительные документы, чтобы это подтвердить. Например, у нас были женщины старше 40 лет, они проживают по свидетельствам о рождении. У них уже семьи, дети, внуки, и получается, что под риском без гражданства как наследственность. Из-за того, что у нее нет паспорта гражданина Республики Таджикистан, ее дети не могут получить свидетельство о рождении и соответственно паспорт, внуки, которые родились у детей, не могут получить свидетельства.
